PRICING DETAILS:
All prices are per person in U.S. dollars. Regular Rates vary for each Adventures by Disney package (“vacation package”) based primarily on when you book, when you travel, room configuration and room location (in the case of river and expedition cruise packages). Once your deposit is received by Adventures by Disney Travel Services, Inc. (“we”, “our” or “us”), your vacation package price is guaranteed for your party, except where price increases may result from increases in government taxes or fees. Guests added to your party after initial booking will be priced at the then-prevailing rate. All prices are subject to change without notice. A single supplement applies; please call a Vacationista for details. Room configurations are subject to availability; please see “Note on Accommodations” in the corresponding description of each vacation package for rooming information. Child rates apply to Guests under age 12 at the time of travel. All Guests under age 18 at the time of travel must be accompanied by a parent or legal guardian in the same room.

For Private Adventures Only: The price per person reflected in this confirmation is based on the number of participants on this Private Adventures trip. In the event of a participant cancellation, we reserve the right to increase the price per person reflected in this confirmation. We shall notify you if the price per person increases, and you agree to pay the increased price prior to the start of your trip. In the event you add one or more participants to your Private Adventures trip, we reserve the right to reduce the price per person reflected in this confirmation.

DEPOSIT/PAYMENT REQUIREMENTS:

A deposit is required to confirm a reservation, unless the reservation is made on or after the final payment date (as defined below) for the vacation package, in which case full payment is required. The deposit amount will be equal to: (i) fifteen percent (15%) of the vacation package price, not including any optional add-ins, with respect to Expedition Cruises and Buenos Aires Escape (the “Expedition Deposit”), (ii) twenty percent (20%) of the vacation package price, not including any optional add-ins, with respect to Private Adventures (the “Private Adventures Deposit”), and (iii) ten percent (10%) of the vacation package price per Guest, not including any optional add-ons, for all other trips (the “Regular Deposit”; each of the Expedition Deposit, the Private Adventures Deposit, and the Regular Deposit shall be referred to herein as the “Deposit”).

Travel During the 2021 and 2022 Adventure Season (excluding River Cruises, Expedition Cruises, Buenos Aires Escapes, and Private Adventures)
For reservations made 65 calendar days or more prior to the adventure start date, the Deposit is refundable until the earlier of (i) 14 calendar days after the original booking and (ii) the date on which the executed Adventure Travel Agreement is returned to us; thereafter the Deposit becomes nonrefundable unless otherwise stated in your Guest Confirmation. For reservations made less than 65 calendar days prior to the adventure start date, we will hold your reservation for up to 72 hours (the “Hold Period”) without the Deposit to allow you time to review the Adventure Travel Agreement (see below). You must confirm your reservation no later than the end of the Hold Period and pay an amount equal to 100% of the vacation package price per Guest (subject to the Cancellation Fees section below), or else the reservation will be cancelled. Full payment shall be due 65 calendar days prior to the adventure start date (the “2021/2022 Final Payment Date”), unless the reservation is made after the 2021/2022 Final Payment Date, in which case full payment will be due on the date the reservation is made.

Travel during the 2022 Adventure Season on River Cruises and Expedition Cruises
For reservations made 90 calendar days or more prior to the adventure start date, the Deposit is refundable until the earlier of (i) 14 calendar days after the original booking and (ii) the date on which the executed Adventure Travel Agreement is returned to us; thereafter the Deposit becomes nonrefundable, unless otherwise stated in your Guest Confirmation. For reservations made less than 90 calendar days prior to the adventure start date, we will hold your reservation through the end of the Hold Period without the Deposit to allow you time to review the Adventure Travel Agreement. You must confirm your reservation no later than the end of the Hold Period and pay an amount equal to 100% of the vacation package price per Guest (subject to the Cancellation Fees section below), or else the reservation will be cancelled. Unless stated otherwise in your Guest Confirmation, full payment shall be due 90 calendar days prior to the vacation start date (the “REB Final Payment Date”), unless the reservation is made after the REB Final Payment Date, in which case full payment will be due on the date the reservation is made.

Travel during the 2022 Adventure Season on Private Adventures and 2023 Adventure Season on River Cruises, Expedition Cruises and Buenos Aires Escapes
For reservations made 120 calendar days or more prior to the vacation start date, the Deposit is refundable until the earlier of (i) 14 calendar days after the original booking and (ii) the date on which the executed Adventure Travel Agreement is returned to us; thereafter the Deposit becomes nonrefundable, unless otherwise stated in your Guest Confirmation. For reservations made less than 120 calendar days prior to the adventure start date, we will hold your reservation through the end of the Hold Period without the Deposit to allow you time to review the Adventure Travel Agreement. You must confirm your reservation no later than the end of the Hold Period and pay an amount equal to 100% of the vacation package price per Guest (subject to the Cancellation Fees section below), or else the reservation will be cancelled. Unless stated otherwise in your Guest Confirmation, full payment shall be due 120 calendar days prior to the vacation start date (the “PA Final Payment Date”), unless the reservation is made after the PA Final Payment Date, in which case full payment will be due on the date the reservation is made. For Private Adventures, a vacation will not be confirmed until we receive the executed Adventure Travel Agreement.

Payment(s) must be in U.S. dollars and received in our office on the date(s) set forth in the Guest Confirmation or vacation packages will be deemed cancelled by you. We accept all major credit cards, Disney Gift Cards, the Disney Rewards Card and checks. If you pay by check, please: (i) write your reservation number and vacation start date on the face of the check; (ii) ensure that the check has a pre-printed name, address and account number; (iii) do not post-date your check (we will reject it); (iv) ensure that we receive your check by the date set forth in your Confirmation; and (v) make check payable to, and mail to, Adventures by Disney Travel Services, Inc., Attn: Travel Account Operations, P.O. Box 10155 Lake Buena Vista, FL 32830 or courier to Adventures by Disney Travel Services, Inc., Attn: Travel Account Operations, 210 Celebration Place, Celebration, FL 34747. Do not send cash. Payment and deposit policy for private group travel and other group travel (collectively, “Group Travel”) may vary. Please contact your travel agent for complete details. Failure to strictly comply with the deposit and final payment schedules, or any other applicable policies and procedures, will result in the automatic cancellation of pending reservations and applicable fees will be assessed.

NAME CHANGES/GUEST CANCELLATIONS/REFUNDS:

Reservations and package components are non-transferable. We will make a reasonable effort to accommodate changes to Guest names prior to departure provided that at least one member of the originally-booked party travels; however, we reserve the right to pass on to you any third party costs (such as from airlines or Suppliers (as defined herein)) we incur in so doing. You may cancel by telephone or in writing. The time of cancellation will be the date upon which we receive notice from you.

For reservations made 65 calendar days or more prior to the adventure start date, if you fail to execute and return the Adventure Travel Agreement to us no later than 14 calendar days after booking, it will be deemed a cancellation by you. For reservations made less than 65 calendar days prior to the adventure start date, if you fail to execute and return the Adventure Travel Agreement to us no later than the end of the Hold Period, it will be deemed a cancellation by you.

Travel during the 2022 Adventure Season on River Cruises and Expedition Cruises
For reservations made 90 calendar days or more prior to the adventure start date, if you fail to execute and return the Adventure Travel Agreement to us no later than 14 calendar days after booking, it will be deemed a cancellation by you. For reservations made less than 90 calendar days prior to the adventure start date, if you fail to execute and return the Adventure Travel Agreement to us no later than the end of the Hold Period, it will be deemed a cancellation by you.

For reservations made 120 calendar days or more prior to the adventure start date, if you fail to execute and return the Adventure Travel Agreement to us no later than 14 calendar days after booking, it will be deemed a cancellation by you. For reservations made less than 120 calendar days prior to the adventure start date, if you fail to execute and return the Adventure Travel Agreement to us no later than the end of the Hold Period, it will be deemed a cancellation by you.

If you make changes to the vacation start date or chosen vacation, it will be deemed a cancellation by you. If you cancel, amounts paid, minus cancellation fees and nonrefundable amounts, will be promptly refunded. No refunds will be made in the event of interruption or cancellation by you after the vacation start date. All appropriate refunds will be made in U.S. dollars directly to your credit card, via check or through your travel agent (if applicable). We will not be responsible for the receipt of refund monies by you from your travel agent, some of whom may withhold an agency cancellation fee.

Notwithstanding the above cancellation fee schedule: for reservations made less than 65 calendar days prior to the adventure start date, we will hold your reservation for the Hold Period without a Deposit and you must confirm your reservation, return executed Adventure Travel Agreements, and make a non-refundable payment equal to 100% of the vacation package price per Guest in your travelling party no later than the end of such Hold Period or else the reservation will be cancelled.

The cancellation fees set forth above shall apply irrespective of resale by us. Cancellation policy for Group Travel may vary. Please contact us or your travel agent, if applicable, for complete details. The cancellation terms above apply only to the vacation package price and pre-/post-stay hotel night add-ons, and exclude, among other things, cancellation charges from air carriers. Please see Vacation Protection Plan and Adventure Travel Agreement, below.

AIRLINE SERVICE:

We only book flight reservations originating/terminating in the U.S. Our airfares, which are non-refundable, must be purchased in conjunction with a vacation package, and payment in full is due at the time of booking the flight. Airlines may impose change or cancellation charges in addition to those set forth above. In purchasing, selling or arranging your airfare, we are acting as your agent only and have no liability or responsibility for the performance of services by the airlines including, but not limited to, accident, death, personal injury, property damage or flight cancellation or delay. Your airline ticket and associated terms and conditions constitute the entire agreement between you and the airline (and not us), even if purchased through us. It is your responsibility to apprise yourself of, and comply with, the airlines’ terms and conditions of service and airport security requirements.

ELIGIBILITY:

Our website establishes minimum eligibility ages for each itinerary, as well as recommended minimum ages, which are based on several factors; however, some activities within a vacation may have weight/height restrictions and/or different minimum ages than our overall minimum eligibility age or recommended minimum age. Please contact us for details. All persons under age 18 must be accompanied by a parent or legal guardian over age 21 in the same room. By booking your vacation package, you represent and certify that you and all members of your traveling party: (i) have selected a vacation that is appropriate to your abilities and interests; and (ii) are free from any physical condition or disability that would create a hazard for you, the Adventure Guides or other Guests. Please consult your doctor. We have the right, but not the obligation, to deny participation to any Guest and to remove from any vacation, at the Guest’s sole expense, any Guest whose condition is such that he or she could create a hazard to himself or herself, the Adventure Guides or other Guests or otherwise impacts the enjoyment of other Guests or disrupts the trip.

For the safety of parent and child, women who have entered their 24th week of pregnancy as of the adventure start date or who will enter their 24th week of pregnancy during their trip will not be permitted to participate due to safety concerns. Neither a physician’s medical statement nor a waiver of liability will be accepted by us. In addition, we cannot be held responsible or liable for any complications relating to pregnancy at any stage.

CLAIMS/NOTICE/REQUIREMENTS/TIME LIMITS:

No claim for delay, detention, personal injury, illness, emotional distress or death of a Guest, or for loss of or damage to any of your property (collectively, “Damages”), may be brought against us or the tour operator, ABD,LLC (“tour operator”) unless you provide written notice of same to us and tour operator within 6 months after the date of the event upon which such claim is based (within 30 calendar days after the termination of the tour for a claim of property loss or damage) and no legal action may be brought against us or tour operator for any Damages, unless such legal action is commenced within 1 year from the date of the event upon which such claim is based (within one year after the termination of the tour for a claim of property loss or damage), and legal process relating to such action is served on us or tour operator within 120 calendar days after filing, notwithstanding any provision of law of any state, territory, possession or country to the contrary. Our and tour operator’s liability, if any, for loss of or damage to your property is limited to US$300 in aggregate per Guest per tour, unless upon the start of the tour you declare the true value of the property in writing and pay 5% of the true value declared in excess of US$300 to us, in which case our and tour operator’s liability, if any, will be limited to the true value declared not to exceed US$5,000 in aggregate. All settlements will be made based on actual cash value (replacement cost, less depreciation) up to the stated limits of our and tour operator’s liability. We and tour operator will not reimburse Guests for losses or Damages due to ordinary wear and tear, acts of God, events that are beyond our control or events that are without our or tour operator’s fault or negligence.

DOCUMENTATION REQUIRED TO TRAVEL/GUEST RESPONSIBILITIES:

You are solely responsible for obtaining any documents required for your participation on the trip such as a valid passport, all visas, vaccination certificates, and any other documents. Further, you are solely responsible for obtaining current travel advisories, warnings and requirements by contacting your travel agent, applicable embassies and consulates. We strongly encourage you to visit the U.S. State Department’s website at http://travel.state.gov and the U.S. Centers for Disease Control and Prevention (CDC) website at http://www.cdc.gov. Non-U.S. residents please consult the appropriate consulates regarding passport, visa and other document requirements. All Guests must have valid government-issued proof of citizenship to travel, in addition to any other requirements of the country of origin and countries visited. Those without proper documentation may be denied travel. In addition, you may be denied entry to the countries visited if they do not meet the country’s entry requirements. If you did not purchase air travel through us, you are solely responsible for notifying us of flight changes affecting your arrival or we will not be able to meet you at the specified arrival airport. Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be your responsibility.

VACATION PROTECTION PLAN:

Generally speaking, the Vacation Protection Plan (“Plan”) provides insurance coverage for trip cancellation and interruption, baggage protection and delay, travel accidents and delay, and emergency medical and dental services and certain associated transportation, on select trips. You may elect to purchase the Plan at the time of booking or at any time prior to, or at time of, final payment. If you purchase and pay for the Plan in full within 14 calendar days of the initial trip deposit/payment (but no later than when final payment is made), certain pre-existing medical conditions may also be covered; however, if you purchase and pay in full for the Plan more than 14 calendar days after the initial trip deposit/payment (but no later than when final payment is made), pre-existing medical conditions will not be covered. The Plan is non-transferable and is not available for the Antarctica & Patagonia Expedition Cruise, Galápagos Islands Expedition Cruise, Buenos Aires Escape or the Amazon Escape during the 2022 Adventure Season.

ITINERARY CHANGES AND CANCELLATION BY US:

We will make every reasonable effort to operate the vacations as advertised; however, we and tour operator reserve the right to curtail or modify the itinerary, or to substitute activities, hotels, meals or transportation as we deem necessary. Please also note that during certain holidays and peak periods or due to repairs or renovations, some activities may be disrupted or unavailable. Deviations from planned vacation package itineraries or any aspects of the travel may occur. If for river or expedition cruise packages conditions make cruise routes unsafe for navigation or in other respects, or raise sufficient doubt about safety, we and tour operator reserve the right to modify or provide alternate services, which may include, but are not limited to, providing accommodation on the docked ship or on land and/or substituting ground arrangements for river or expedition cruise transportation. None of these modifications or changes shall affect the vacation package price or entitle you to any credit or refund. We and tour operator further reserve the right to reduce the number of Adventure Guides, and to modify other services to accommodate a smaller group, if a minimum number of Guests is not reached. Similarly, the stated group maximum size may be marginally exceeded if necessary to accommodate a family. We and tour operator reserve the right to cancel a trip at any time prior to its start for any reason, including if there are too few Guests, or the quality of the trip or the safety of the Guests would, in our opinion, be compromised, such as may result from unforeseen circumstances (acts of God) or other circumstances beyond our reasonable control. If we cancel your trip prior to its start because there are too few Guests: (i) we will attempt to re-book you on another departure of the same itinerary, subject to availability, and we will bear any reasonable airline re-booking charges; however, if we are unable to rebook you, we will issue a full refund of your vacation package price and Plan (unless you have filed a claim); and (ii) if you booked airfare through us, we will issue a full refund of your airfare; and (iii) if you did not book airfare through us, we will reimburse you for your reasonable out-of-pocket (subject to proof) airline cancellation charges or, in the case of bookings using frequent flier miles, a reasonable cancellation service fee, provided you have exercised best efforts to mitigate such charges/fees; and (iv) the aforesaid payments and/or rebooking by us shall constitute a full settlement. The immediately preceding sentence does not apply to any cancellation (or deemed cancellation under the agreement between the group travel organizer and us) of a group travel reservation by the organizer of the group travel experience, for whatever reason, and in the event of such cancellation you will not be entitled to any refund or reimbursement from us of any amounts.

GUESTS NEEDING SPECIAL ASSISTANCE:

Certain itineraries may include activities that present challenges to or are not suitable for Guests with special needs. We strongly recommend that Guests requiring assistance be accompanied by a companion who is capable of, and totally responsible for, providing assistance. Neither we nor our Suppliers may physically lift or assist Guests onto transportation vehicles or otherwise. Please contact a Vacationista to discuss your specific needs.

SPECIAL REQUESTS:

We will make a reasonable effort to accommodate special requests, such as smoking, adjacent or connecting rooms, bed size and dietary needs; however, we cannot guarantee that these requests will be accommodated.

ARRIVE EARLY OR STAY LATE:

We recommend that you arrive a day or two prior to the start of your escorted vacation to get acclimated and to allow for unexpected travel delays. Also, you may choose to stay a day or two after to extend your vacation on your own. Both pre- and post-stays are available at additional cost to you. Please ask a Vacationista for price, details and availability, which unfortunately we cannot guarantee. On some adventures, airport meet & greet and hotel transfer services are available in connection with these additional days. Our special rates for these additional days are only available if booked through us in conjunction with a vacation package and cannot be combined with any other offer. GUEST FEEDBACK:

While not required, we welcome Guest suggestions, ideas, feedback and comments (collectively “Guest Suggestions”). You hereby grant us and our affiliates the right, but do not impose the obligation, to use, disclose and implement any Guest Suggestions you choose to communicate to us without any liability, compensation or obligation on our part.

PHOTOGRAPHY:

By participating in an Adventures by Disney itinerary, you consent to having your name, face, likeness, voice and/or appearance captured in any photographs and videotapes (or portions thereof) in any format, including, but not limited to, print, digital or film media now existing or hereafter developed, and you further acknowledge and agree that such photographs and videotapes (or portions thereof) may be shared with other participants in the adventure. You also agree that any such photographs and videotapes taken outside of the United States may be transferred to the United States.

SERVICE PROVIDERS:

The services provided in connection with the itineraries, including, without limitation, transportation, hotel accommodations, ground operations, restaurants, and other services are purchased from various independent suppliers who are not affiliated with us in any way (“Suppliers”). Although we and tour operator endeavor to choose high-quality Suppliers, neither we nor tour operator has the right to control their operations and therefore make these travel arrangements upon the express conditions that we, tour operator and our own agents, employees and affiliates shall not be liable for any delay, mishap, inconvenience, expense, irregularity, bodily injury, illness, emotional distress, death or damage or loss to property occasioned through the conduct or omission or default of any Supplier, each of which is subject to laws of the state or country where the service is provided. As a condition precedent to your participation in the vacation package, we and some of our Suppliers require that you execute and return to us an assumption of the risks and release of liability form (in our case, the Adventure Travel Agreement (see below)).

ADVENTURE TRAVEL AGREEMENT:

The Adventure Travel Agreement is an assumption of the risks and release of liability form provided to you upon booking that you will be required to sign and return to us prior to your adventure start date in accordance with the deadlines below.

You will be required to sign and return the Adventure Travel Agreement to us no later than (i) 14 calendar days after booking, or (ii) the end of the Hold Period. Failure to do so will be deemed a cancellation by you. You have 14 calendar days after booking to cancel and receive a full refund of your deposit (see Name Changes/Guest Cancellations/Refunds) if you choose not to execute the Adventure Travel Agreement. If a Hold Period applies to your reservation, we will hold your reservation during the Hold Period to provide you with an opportunity to review and execute the Adventure Travel Agreement and make a payment in an amount equal to 100% of the vacation package price per Guest (subject to the Cancellation Fees section above). We strongly advise that you not make any non-cancelable commitments within 14 calendar days after booking, or during the Hold Period, as applicable. Once we receive your executed Adventure Travel Agreement your deposit is nonrefundable unless otherwise stated in your Guest Confirmation.

ADDITIONAL TERMS APPLICABLE TO RIVER CRUISE PACKAGES:

These additional terms apply to river cruise packages. Passenger Ticket Contract: The river cruise component of the river cruise package, including vessel, vessel amenities, food and beverages served thereon and vessel crew, is provided by a Supplier, AMAWaterways Gmbh (“AMA”). Prior to embarkation you will receive a Passenger Ticket Contract, which governs your relationship with AMA as a passenger on the river cruise vessel and establishes limits of liability, limits on claims and time limits for making claims, as well as other restrictions, limits and disclaimers limiting AMA’s liability to you, which are wholly separate from, and independent of, these Terms and Conditions and the Adventure Travel Agreement, which govern your relationship with us and tour operator. Excursions: Certain excursions have limited capacity and are available to Guests on a first-come, first-served basis. As a result, we are unable to guarantee that each Guest will be able to participate in each excursion such Guest requests. Baggage: You may bring aboard the river cruise vessel, without additional charge, up to one (1) suitcase per person. Additional baggage will be subject to excess baggage charges.

ADDITIONAL TERMS APPLICABLE TO EXPEDITION CRUISE PACKAGES:

These additional terms apply to expedition cruise packages. Passenger Ticket Contract: The expedition cruise component of the Antarctica & Patagonia and Arctic expedition cruise packages, including vessel, vessel amenities, food and beverages served thereon and vessel crew, is provided by a Supplier, La Compagnie du Ponant (“PONANT”). Prior to embarkation you will receive a Passenger Ticket Contract, which governs your relationship with PONANT as a passenger on the expedition cruise vessel and establishes limits of liability, limits on claims and time limits for making claims, as well as other restrictions, limits and disclaimers limiting PONANT’s liability to you, which are wholly separate from, and independent of, these Terms and Conditions and the Adventure Travel Agreement, which govern your relationship with us and tour operator. Excursions: Certain excursions have limited capacity and are available to Guests on a first-come, first-served basis. As a result, we are unable to guarantee that each Guest will be able to participate in each excursion such Guest requests. PONANT Medical Form for Antarctica and Arctic Expedition Cruise: To participate in the Antarctica & Patagonia or Arctic Expedition Cruise, you must complete a medical questionnaire from the cruise operator PONANT that will be emailed to you approximately 90 calendar days prior to your departure and must be returned to PONANT at least 45 calendar days prior to departure. PONANT retains the right to deny Guests the ability to sail based on their failure to timely return the medical questionnaire or if a physician cannot clear the Guest to sail upon review of the Guests’ health condition or responses to the medical questionnaire.

PRIVACY POLICY:

You consent to the Terms of Conditions, the Terms of Use (see https://disneytermsofuse.com/), and acknowledge you have read our Privacy Policy (see https://privacy.thewaltdisneycompany.com/en/), and, as applicable, Your California Privacy Rights (see https://privacy.thewaltdisneycompany.com/en/current-privacy-policy/your-california-privacy-rights/). If any portion of the trip is fulfilled by Suppliers (as defined above), by booking the trip, participant understands that Adventures by Disney may provide participant personal information to Suppliers for their independent use to fulfill the reservation.

ENTIRE AGREEMENT:

The Confirmation(s), these Terms and Conditions and those contained on our website, and the pre-departure materials constitute the entire agreement of the parties with respect to the subject Adventures by Disney vacation and supersede any and all previous communications between the parties, whether written or oral, with respect to such subject matter. This agreement is deemed to be entered into and consummated in the state of Florida and shall be construed in accordance with the laws of the state of Florida. Any legal action relating to this agreement shall be brought and maintained exclusively before the superior court located in Orange County, Florida, USA.

TRAVEL CONSUMER RESTITUTION CORPORATION:

For Persons Located in California: This business is a participant in the Travel Consumer Restitution Corporation (“TCRC”). If you were located in California at the time of sale, you may request reimbursement from TCRC if you are owed a refund of more than US$50 for transportation or travel services which was not refunded in a timely manner by us. The maximum amount which may be paid by the TCRC to any one Guest is the total amount paid by or on behalf of the Guest to us, not to exceed US$15,000. A claim must be submitted to the TCRC within twelve months after the scheduled completion date of the travel. A claim must include sufficient information and documentation to prove your claim, plus a processing fee. You must agree to waive your right to other civil remedies against us for matters arising out of a sale for which you file a claim with the TCRC, if you were located in California at the time of the sale. UNITED STATES TOUR OPERATORS ASSOCIATION $1 MILLION TRAVELERS ASSISTANCE PROGRAM:

Adventures by Disney, as an active member of USTOA, is required to post $1 Million with USTOA to be used to reimburse, in accordance with the terms and conditions of the USTOA $1 Million Travelers Assistance Program, the advance payments of Adventures by Disney’s customers in the unlikely event of Adventures by Disney’s bankruptcy, insolvency or cessation of business. Further, you should understand that the $1 Million posted by Adventures by Disney may be sufficient to provide only a partial recovery of the advance payments received by Adventures by Disney. TERMS AND CONDITIONS OF MY MICKEY VACATION TRAVEL AND/OR DREAMS FULFILLED TRAVEL

I have reviewed the dates, times, payment due dates, and cancellation policy for reservations made on my behalf by My Mickey Vacation Travel, and I agree that they are correct and accurate. Notice: Passenger(s) are required to carry proper identification when traveling. You as the traveler are responsible for understanding & obtaining the proper travel documents in advance of your travel commencement.

My Mickey Vacation Travel acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”). My Mickey Vacation Travel is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.  For Walt Disney World travel, I give my express permission to representatives of My Mickey Vacation Travel to create a My Disney Experience account on my behalf on the Disney website for purposes of planning my vacation. I understand that my representative from My Mickey Vacation Travel will review all privacy settings with me, and will provide all information necessary as it relates to integrated experiences while at Walt Disney World, including but not limited to dining and other features. I also understand and agree that I may opt out of any integration with my experience at Walt Disney World.  I agree to all of the terms and conditions of My Disney Experience as found at http://disneyworld.disney.go.com/media/park-experience-terms-andconditions.html, and authorize my representative of My Mickey Vacation Travel to accept these terms on my behalf.

My Mickey Vacation Travel assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under My Mickey Vacation Travel’s control. You hereby release My Mickey Vacation Travel from all claims arising out of any problem covered in this paragraph.

You agree that the courts in Orange County, Florida will be the exclusive jurisdiction for all claims brought by you or My Mickey Vacation Travel, and you hereby submit to the personal jurisdiction of those courts.

Fee Based Services: My Mickey Vacation Travel offers fee-based travel planning services which are separate and distinct from the booking services provided as an agent of any supplier. Fee bases services are available for consulting and itinerary planning. Any and all planning fees will be discussed in advance between the travel agent and the client.  Fees for such services will be collected by My Mickey Vacation Travel via credit cards through a secure merchant service. At no time will My Mickey Vacation Travel ever use our merchant service to collect a travel deposit on behalf of a supplier. My Mickey Vacation Travel will be held harmless, assumes no liability, and expresses no warranty as to these services. Although every effort will be made by My Mickey Vacation Travel to obtain any and all requested advance dining reservations, if requested, My Mickey Vacation Travel can not be held liable for any inventory issues on behalf of the suppliers that prohibit the obtaining of specific reservation times.

I further understand and acknowledge that travel to many parts of the world may involve the risk of a variety of hazards to my health and/or safety, including but not limited to disease, crime, terrorism, and warfare.  Because each traveler’s risk tolerance is different, [your travel agency name] is not in a position to advise me whether I should travel to any particular place at any particular time.  Rather, to assist me in making an informed decision, I should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov).   For medical information, My Mickey Vacation Travel recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.

I will review my travel documents for accuracy upon receipt and understand that I may contact My Mickey Vacation Travel if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.

I have been advised to use a credit card as this may offer me the opportunity to dispute the charge should a vendor cease operating.

I understand that the Transportation Security Administration (TSA) requires me to carry a government-issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.  I further acknowledge that beginning on October 1, 2020, I must present a driver’s license or another form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information).

I understand that if traveling internationally, I must have a valid passport and, depending upon my destination and nationality, I may need to obtain one or more visas.

Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. I understand that the airline tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by [your travel agency name] to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize [your travel agency name] to charge my credit card for such additional amounts.

COVID-19 DISCLAIMER AND RELEASE

  1. Health and Other Hazards: You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country.
  2. Vaccination Requirements and Other Rules: We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. For the latest travel supplier requirements, check the website of each supplier, and keep checking because these rules are constantly changing, and we are not responsible for those changes.
  3. Financial Condition of Travel Suppliers: We are not responsible for the acts or omissions of travel suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit in lieu of a refund.
  4. Rebooking: If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, but we will charge a nonrefundable fee for such services.
  5. Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.
  6. RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED IN PARAGRAPHS 1-3 ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS,  CAUSES  OF  ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in Orange County, Florida will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

I understand that I may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.
